1. Acceptable Use of Services
The Nexus platform is a clinical software solution designed to record and process physical measurements from calibrated devices. You agree that:
- You will use the platform only for lawful clinical, educational, or performance tracking purposes.
- You will not upload or transmit any unauthorized malicious code, script, or payloads.
- You will maintain active security over your login credentials, API tokens, and connected devices.
- You will not reverse engineer or attempt to breach security controls protecting our server workloads.
2. Medical Disclaimer
Important Notice: Nexus is a tool designed to store, structure, and visualize physical, biomechanical, and orthopedic observations. It does not provide medical diagnoses, treatment recommendations, or professional clinical evaluations. All reports, metrics, symmetry ratios, and readiness scores are supplementary data points. Final medical determinations and clinical workflows remain the sole responsibility of the certified clinical practitioner.
3. Intellectual Property
All brand identity, slogans, product names (including “Just Kinetics”, “Nexus”, and “Precision Performance Intelligence”), custom vector visualizers, UI animations, icons, databases, and source code are the exclusive intellectual property of Just Kinetics or its technology suppliers. Unauthorized distribution or copying is strictly prohibited.
4. Limitation of Liability
To the maximum extent permitted by applicable law, Just Kinetics shall not be liable for any indirect, consequential, punitive, or special damages, including loss of clinical revenue, data breach liability arising from client negligence, hardware miscalibration, or treatment plan modifications. Our total aggregate liability under these terms is capped at the total amount paid by your organization for active licenses during the preceding 12-month period.
5. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of Ireland for European operations, and the laws of South Africa for operations within the Southern African region, without regard to conflict of law principles. Any dispute arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in Dublin, Ireland, or Cape Town, South Africa, respectively.
